These Terms of Service (“Terms”) govern your use of NFE Studios (the “Service”), operated by Restored Technology LLC. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You may need an account to use certain features. You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.
Age. You must be 18 or older to create an account, and you confirm this when you sign up. Children may not hold accounts. A parent or guardian may use the Service with their children under their own account and supervision, and is responsible for that use.
As between you and us, you retain ownership of the inputs you provide and, to the extent permitted by law and the applicable AI providers’ terms, the outputs you generate (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service. Commercial-use rights to generated media may depend on whether you have purchased tokens and on the terms of the underlying AI providers.
AI-generated outputs are produced from models that many users share; similar outputs may be generated for others, and outputs may not be eligible for certain intellectual-property protection. You are responsible for ensuring your use of any output is lawful.
What is and isn’t protectable. Under current U.S. Copyright Office guidance, material generated purely by AI is not protected by copyright, and a prompt alone does not make you the author of an output. What can be protected is your own human authorship — for example, text you write, and your creative selection, coordination, arrangement, or editing of AI-generated material. If you register a work that contains AI-generated content, you must disclose the AI-generated portions and describe your human contribution to the Copyright Office. We make no representation that any particular output is copyrightable, and purchasing tokens provides access, hosting, watermark-free export, and content-protection hosting — not a grant of copyright.
You agree not to use the Service to create, upload, or distribute content that:
We may remove content and suspend or terminate accounts that violate these Terms.
Voice & likeness (digital replicas). The Service can synthesize realistic voices and images. You may only create or distribute a realistic replica of a real person’s voice or appearance if you have that person’s consent (or are that person). You may not use the Service to generate sexual content, face-swaps or deepfakes of real people, non-consensual intimate imagery, or any sexualized depiction of a minor. When you render or download a narrated film, you confirm you hold the necessary rights and consents to every voice, likeness, and piece of music it contains.
The Service uses artificial intelligence to generate text, images, and audio. Outputs may be inaccurate, incomplete, biased, offensive, or otherwise unsuitable, and may not reflect real facts, people, or events. Outputs are not professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing, editing, and verifying any output before using or publishing it.
Live Avatar, generated characters and scenes. Real-time AI video and generated images are imperfect: the join between a character and your body can blur or shift, fast movement can smear, small details can change from frame to frame, and results degrade when more than one person is in view. Generated images may contain errors such as malformed hands or stray marks. We improve results as new models become available but do not guarantee any particular output. Realistic characters may only be created from your own description, must be fictional or depict historical figures who died more than 70 years ago, and may not be used to impersonate, deceive, or depict any real living person.
The Service, including the NFE Studios name, logo, and software, is owned by us and protected by law. These Terms do not grant you any rights in our brand or software except as needed to use the Service.
The Service relies on third-party providers (including Anthropic, OpenAI, ElevenLabs, Supabase, Vercel, and Stripe). Your use may also be subject to their terms, and we are not responsible for their services.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NFE STUDIOS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $100 IF YOU PAID NOTHING).
You agree to indemnify and hold harmless NFE Studios and its operators from claims arising out of Your Content or your misuse of the Service or violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.
We may update these Terms; material changes will be reflected by the “Last updated” date and, where appropriate, additional notice. Continued use after changes means you accept them.
These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict- of-laws rules, and disputes will be resolved in the courts located there, unless otherwise required by applicable law.
We act on reports of unauthorized voice/likeness replicas, copyright infringement, and harmful content. If you believe content on the Service uses your voice or likeness without consent, infringes your copyright, or is otherwise harmful, report it using the Report content link in the app, or contact us at the address below. Please include a link or description of the content, the reason, and how to reach you.
For copyright complaints, include the information generally required for a takedown notice: identification of the work, identification of the allegedly infringing material and where it appears, your contact information, a statement of good-faith belief that the use is unauthorized, a statement (under penalty of perjury) that your notice is accurate and you are authorized to act, and your signature. We will review valid reports promptly, remove or disable content where warranted, and may suspend repeat infringers. Send notices to our designated copyright agent:
